§ 1 Scope of Application

1.1 Provider

These General Terms and Conditions apply to all contracts between:

(hereinafter referred to as "Solidqua" or "Provider")

and the customer (hereinafter referred to as "Customer").

1.2 Object of the Contract

Solidqua provides services in the field of AI-powered property risk analysis for Portuguese real estate (hereinafter referred to as "Sofia-Check" or "Service").

1.3 Deviating Conditions

Deviating terms and conditions of the Customer are not recognized unless Solidqua expressly agrees to their validity in writing.

§ 2 Conclusion of Contract

2.1 Booking Process

The contract is concluded by booking a package (Basic Check, Premium Audit, or Full Service) via the website www.solidqua.com and the subsequent confirmation of payment via Stripe.

2.2 Order Confirmation

After successful receipt of payment, the Customer receives an order confirmation via email with instructions on how to upload the necessary documents.

§ 3 Scope of Services

3.1 Basic Check (€297)

  • AI-powered document analysis (Sofia System)
  • Automated registry cross-check (3 data sources)
  • PDF Report (15-20 pages) with risk assessment
  • Checklist for further steps
  • Email support
  • Standard delivery time: 48 hours

3.2 Premium Audit (€597)

  • All services from the Basic Check
  • 60-minute personal video consultation
  • Enhanced risk analysis
  • Renovation cost estimation
  • Negotiation strategy
  • Attorney recommendations (Portugal)
  • 30-day follow-up support
  • Express delivery time: 24 hours

3.3 Full Service (€1,297)

  • All services from the Premium Audit
  • On-site inspection (100 km radius included)
  • Water quality analysis
  • Full renovation plan
  • Contractor mediation
  • Local authority support
  • 6 months of ongoing support
  • Direct WhatsApp contact

3.4 Required Documentation

For a complete analysis, the following documents should ideally be provided:

  • Draft purchase contract
  • Floor plans / Architectural plans
  • Sales prospectus (Exposé)
  • Caderneta Predial (Tax certificate)
  • Certidão Permanente (Land registry extract)
  • Building permits

An analysis is also possible with incomplete documentation. In this case, Solidqua will point out missing documents and advise on which additional records would be beneficial.

§ 4 Obligations of the Customer

4.1 Provision of Documents

The Customer agrees to provide all available documents completely and truthfully. Incomplete or incorrect information may affect the quality of the analysis.

4.2 Duty to Cooperate

The Customer agrees to respond to inquiries in a timely manner (within 3 business days). Delays due to a lack of cooperation will extend the delivery period accordingly.

§ 5 Compensation and Payment

5.1 Prices

The prices stated on the website at the time of booking shall apply. All prices include the applicable statutory value-added tax.

5.2 Payment Processing

Payment is made exclusively via Stripe. The contract is concluded upon completion of the payment.

5.3 Discount Codes

Discount codes (e.g., SICHER100) can be entered during the booking process and will be deducted from the total price. Discount codes cannot be applied retrospectively.

§ 6 Delivery Terms

6.1 Standard Delivery Times

  • Basic Check: 48 hours after full document upload
  • Premium Audit: 24 hours after full document upload
  • Full Service: Individual appointment scheduling

6.2 Delays

Delays caused by force majeure, incomplete documentation, or lack of cooperation by the Customer will extend the delivery period accordingly.

§ 7 Liability and Warranty

7.1 Duty of Care

Solidqua agrees to perform all analyses with the utmost care. The analysis is based on the documents provided and publicly accessible databases.

7.2 Limitation of Liability

The Sofia-Check is a risk analysis and decision-making aid. Solidqua does not guarantee:

  • The completeness or accuracy of the documents provided by the Customer
  • Undocumented structural changes or hidden defects
  • Future developments (changes in law, market trends, etc.)

7.3 Exclusion of Liability

Solidqua is liable for intent and gross negligence. For slight negligence, Solidqua is only liable for the breach of essential contractual obligations (cardinal obligations). In this case, liability is limited to the foreseeable, contract-typical damage.

7.4 No Legal Advice

The Sofia-Check does not replace legal advice. For legal questions, we recommend consulting a qualified attorney licensed in Portugal.

§ 8 Right of Withdrawal

Consumers have a 14-day right of withdrawal. Detailed information can be found in our Cancellation Policy.

§ 9 Satisfaction Guarantee (Voluntary Goodwill)

9.1 Money-Back Guarantee

If you are not satisfied with the service, we will refund the full purchase price – without lengthy discussion and without conditions.

9.2 Requirements

  • Refund request within 14 days of receiving the report
  • Short email to info@solidqua.com with the reason (optional)
  • Refund will be processed within 5 business days

9.3 No Right of Withdrawal after Performance

This goodwill policy applies in addition to the statutory right of withdrawal. Once the contract has been fully performed (delivery of the report), the statutory right of withdrawal expires.

§ 10 Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy and the provisions of the GDPR.

10.1 Confidentiality

All uploaded documents and customer data will be treated confidentially and will not be passed on to third parties.

10.2 Data Deletion

Upon completion of the analysis, customers may request the deletion of their documents at any time via email.

§ 11 Copyright

The reports and analyses created are protected by copyright. The Customer receives a simple, non-transferable right of use for personal use. Disclosure to third parties or publication requires the written consent of Solidqua.

§ 12 Final Provisions

12.1 Applicable Law

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

12.2 Jurisdiction

The place of jurisdiction for all disputes shall be [COMPETENT COURT AT REGISTERED OFFICE], provided the Customer is a merchant or a legal entity under public law.

12.3 Severability Clause

Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.

12.4 Changes to the Terms

Solidqua reserves the right to change these terms. Changes will be communicated to the Customer via email at least four weeks before they take effect. If the Customer does not object within this period, the changed terms are deemed accepted.
